Terms and conditions policy for digital downloadable products
This policy applies to all digital products that are purchased from our website and delivered electronically to your device. By purchasing any of our digital products, you agree to be bound by the following terms and conditions:
– You will receive a link to immediately download the digital product after completing the payment process on the Thank You/Order page. You will also receive a link via email to download your purchase. This link will expire after a certain period of time or after a certain number of downloads, whichever comes first. You are responsible for downloading the product within the specified time frame and ensuring that you have the necessary software and hardware to access and use the product.
– You are granted a non-exclusive, non-transferable, and non-sublicensable license to use the digital product for your personal and non-commercial purposes only. You may not copy, distribute, modify, sell, rent, lease, loan, share, or otherwise transfer the digital product or any part thereof to any third party without our prior written consent. You may not remove any copyright notices or other proprietary markings from the product.
PLEASE NOTE: A certain number of our products do include a Commercial Usage License. These items will be marked on the product page of each item with a link to the licensing page.
– You acknowledge that the digital product is provided “as is” and “as available” without any warranties or guarantees of any kind, express or implied. We do not warrant that the product will meet your requirements, expectations, or preferences, or that it will be error-free, uninterrupted, secure, or compatible with your device or software. We disclaim any liability for any damages or losses arising from your use of or inability to use the product, including but not limited to direct, indirect, incidental, consequential, special, punitive, or exemplary damages.
We will correct, replace, or exchange any product that does not meet necessary and reasonable standards. For example, if a product is clearly fuzzy or blurry or has visible design flaws, we will honor a refund or exchange.
– We reserve the right to modify, suspend, or discontinue the availability of any digital product at any time without prior notice or liability to you. We may also terminate your license to use the product if you breach any of these terms and conditions or if we suspect any fraudulent or illegal activity involving the product. In such cases, you must cease using the product immediately and delete it from your device. – These terms and conditions are governed by the laws of the jurisdiction in the state of New Mexico. Any disputes arising from or relating to these terms and conditions or the digital product shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
